## 1. DESARROLLO DE LA SESION CORRESPONDIENTE AL 27-04-82
La sesión comienza a las 10,10 horas con el Dictamen definiti-vo del Fiscal que consume toda la jornada.
## 2.- INCIDENCIAS Y ESTIMACIONES SOBRE EL DESARROLLO DE LA SESION
### 2.1. Dictamen definitivo del Fiscal
El Fiscal inicia su exposición tras un preámbulo en el
que incluye saludos al Presidente de la Sala, sustituído
por enfermedad, y en el que califica su acción como un de--
ber penoso pero ineludible.
El primer bloque de su exposición se refiere al aspecto
conspiratorio previo, cuya iniciación fija en Julio de 1980,
y relata los contactos entre el Tcol. Más, Tcol. Tejero,
Teniente General Miláns, General Armada, en orden a poner
de manifiesto la existencia de dichos contactos con antela--
ción a la comida del 10 de Enero de 1981 entre el General
Armada y el Teniente General Miláns, lo que exluye el que
esta comida fuera el elemento generador de la decisión. Pa-
sa seguidamente a demostrar la imposibilidad de la hipotéti
ca decisión regia al respecto considerando y analizando 3-
distintos tipos de pruebas que define como: cronológica, ac-
titud del General Armada y de posible comprobación. En la -
18. llega a la conclusión de que el General Armada no moti-
va la acción sino que es incluído a partir de la comida del
10 de Enero. En la 2ª. valora la posición del General Arma-
da a lo largo de sus distintas declaraciones en cuanto a ex-
cluir rotundamente cualquier implicación de Su Majestad y
en la 3ª expone las sucesivas acciones públicas de S.M. el
Rey que evidencian su rechazo a la acción.
Continúa con la reunión de la C/. General Cabrera y las
visitas del Coronel Ibáñez al General Armada. Cita las entre-
vistas entre el Tcol. Tejero, Cte. Cortina y Cap. Gómez-Igle-
sias en la C/. Biarritz y entre el Tcol. Tejero y Cte. Corti-
na en Cuzco y posteriormente entre éstos y el General Armada
en la C/. Pintos Juan Gris. Afirma que las declaraciones que
niegan estos hechos tienen escasa credibilidad y que pese a
ellas queda en blanco el tiempo suficiente para que se hubie-
sen desarrollado. Menciona la existencia del despacho de abo-
gados de la C/. Pintor Juan Gris en relación con la empresa
Aseprosa y las vinculaciones de ésta con el CESID y aunque
admite que parte del informe policial sobre este tema es in-
correcto, lo que dá por válido es suficientemente indicativo.
